VAAC London QVA API Service Summary

This is a human-readable summary of (and not a substitute for reading) VAAC London QVA API Licence Agreement and VAAC London QVA Standard Terms. Such summary is merely provided to aid understanding of certain key points. You should carefully read all terms and conditions of VAAC London QVA API Licence Agreement and VAAC London QVA Standard Terms before accepting them as part of the contracting process for the VAAC London QVA API, QVA API Services and Data. Capitalised words in this summary shall have the meanings ascribed to them in the VAAC London QVA API Licence Agreement and VAAC London QVA Standard Terms.

 

You are free to use the VAAC London QVA API and QVA API Services in accordance with clause 3.3 of the VAAC London QVA API Licence Agreement and Data in accordance with clause 8 of the VAAC London QVA Standard Terms. This includes using the same for your own Internal Business Use.

 

Key provisions include:

 

  1. Permitted Use – Data can only used by the Customer solely for use and visualisation of data for aviation purposes within the aviation sector;

 

  1. Liability – other than heads of loss that cannot be excluded under English law, the Met Office zero liability for the VAAC London QVA API and QVA API Services for reasons such as the Met Office is providing the VAAC London QVA API, QVA API Services and Data without charge as part of its responsibilities of operating a VAAC under the ICAO’s remit;

 

  1. Warranties – the Met Office’s sole warranty is that it is authorised to grant the licences to make use of the Deliverables. Whilst the Met Office will provide the VAAC London QVA API and QVA API Services with reasonable skill and care and in all material respects in accordance with the EUROCONTROL SWIM technical specification, the Met Office: (i) provides the VAAC London QVA API and any other API Services on an “as is” basis; (ii) does not provide any warranty about the reliability or availability of the VAAC London QVA API and the QVA API Services; and (iii) does not warrant that the Deliverables will be fit for the Customer’s intended use;

 

  1. Indemnities – You indemnify Us for Your use of the VAAC London QVA API or QVA API Services, Your Users’ use of the Data and You or Your Users’ breach of the VAAC London QVA API Licence Agreement;

 

  1. Adapt – You shall not modify, or change the Data, VAAC London QVA API or QVA API Services;

 

  1. Fair Use - access to the VAAC London QVA API is subject to a fair use policy (currently set out within the VAAC London QVA API user guide) with associated technical measures and monitoring implemented;

 

  1. Termination – Your access may be terminated for reasons such as if we are prohibited from providing the VAAC London QVA API, QVA API Services and/or Data by UK export control laws and guidance, the UK Government and/or applicable sanctions, the Customer’s breach of the VAAC London QVA API Licence Agreement.

 

To register for the VAAC London QVA API Service you will have to confirm that you have read and understood our Privacy Policy, and acknowledge and agree that you will be bound by the terms and conditions of VAAC London QVA API Licence Agreement and VAAC London QVA Standard Terms which will apply to your use of the VAAC London QVA API, QVA API Services and Data until (i) you withdraw from using the VAAC London QVA API or (ii) the Met Office ceases to operate VAAC London or otherwise terminates your right to use the VAAC London QVA API, QVA API Services and Data.
